In Greene County district court Caitlin Suzanne Petersen, 31, of Harcourt was sentenced Jan. 27 to two years in prison after she pleaded guilty to theft- third degree, amended from theft- second degree. The prison term was suspended and she was placed on probation to the Iowa Department of Correctional Services (DCS) for two years. She was fined $625 with a $218.75 surcharge and a $125 Law Enforcement Initiative surcharge. She must also pay $627.90 restitution for her court appointed attorney’s fees and $146.60 court costs.
In a related case in magistrate court, a judgment for a $65 fine with a $22.75 surcharge and a $125 LEI surcharge was entered against Petersen on a charge of theft- fifth degree. She must pay $50 victim restitution in that case. Court costs were $95. (Sentencing: Honorable Joseph B. McCarville)
Samantha Monique Henderson, 28, of Jefferson was sentenced to four days in jail after she changed her plea to guilty to a charge of driving while license revoked. She was fined $1,000 with a $350 surcharge. The court found her unable to pay restitution for her court appointed attorney’s fees or court costs. (Sentencing: McCarville)
Christopher Michael Andrew, 23, of Scranton was granted a deferred judgment Jan. 24 after he changed his plea to guilty to a charge of operating while intoxicated- first offense. He will be on informal probation for one year. He must complete the recommendations of a substance abuse evaluation he has already undergone, and he must also complete a community college drinking drivers school. A judgment was entered for a $1,250 civil penalty; one-half was waived. He must pay a $125 LEI surcharge, $660 restitution for his court appointed attorney’s fees, and $140 court costs. Bruce K. Binkley, 59, of Jefferson was sentenced to 60 days in jail after he changed his plea to guilty to a charge of OWI- first offense. All but two days of the jail time was suspended and he was placed on informal probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense, and he must complete a community college drinking drivers school. He may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of the jail time and community college school. Binkley was fined $1,250 with as $437.50 surcharge; one-half of the fine and surcharge will be waived if he obtains a temporary restricted license. He must pay a $10 drug abuse resistance education (DARE) surcharge and $100 court costs. (Sentencing: McCarville)
Shane Christopher Jewett, 44, of Paton was sentenced Jan. 28 to one year in jail after he changed his plea to guilty to a charge of OWI- second offense. (He changed his plea the morning of his jury trial after a pool of jurors had already been called.) All but seven days of the jail time was suspended and he was placed on probation to the DCS for one year. He must follow the recommendations of a substance abuse evaluation he has already undergone., and he must complete a community college drinking drivers school. Jewett must pay sheriff’s room and board for the time he served, a $1,875 fine with a $666.25 surcharge and a $10 DARE surcharge, and $253 court costs. (Sentencing: McCarville)
Brittany Kay Smith, 33, of Jefferson was sentenced to 30 days in jail after she changed her plea to guilty to a charge of possession of methamphetamine. All but two days of the jail time was suspended and she was placed on probation to the DCS for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. She was fined $315 with a $110.25 surcharge, a $10 DARE surcharge, and a $125 LEI surcharge. She must pay $500 restitution for her court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)
Jerry Lavern Miller, 66, of Grand Junction was sentenced to 180 days in jail after he changed his plea to guilty to a charge of domestic abuse assault display or use weapon. All but 10 days of the jail time was suspended and he was placed on probation to the DCS for one year. He must complete an approved Iowa domestic abuse program and his own expense, and he is prohibited from possessing firearms, offensive weapons or ammunition. Miller was fined $625 with a $218.75 surcharge; both were suspended. He must pay a $100 domestic abuse assault surcharge, $500 restitution for his court appointed attorney’s fees, and $239.28 court costs. (Sentencing: McCarville)
Anthony Scott Gray was sentenced to five years in prison after he changed his plea to guilty to a charge of theft- second degree. The prison term is concurrent to the sentence in a Webster County case. The prison sentence was suspended and he was placed on probation to the DCS for three years. Gray was fined $750 with a $262.50 surcharge; both were suspended. He must pay a $125 LEI surcharge. The count found him unable to pay victim restitution, restitution for his court appointed attorney’s fees or court costs. (Sentencing: McCarville)
Persons pleaded not guilty at arraignment as follows; Justin Ray Lopez, 21, of Jefferson, possession of marijuana- third or subsequent offense; and Marlene Eleanor Anderson, 50, of Ralston, OWI- first offense and driving while license revoked. Trial dates were set for March 3 in both cases.
